    • This Indenture, made the Twenty fifth day of January in the year of our Lord One thousand eight hundred and Sixty five, Between SIR SAMUEL CUNARD , of Halifax, in the Province of Nova Scotia, Baronet (§), of the First part, and Gavin Reid of the Parish of Saint Andrew in the County of Kings County, in Prince Edward Island, of the Second part. Witnesseth, that for and in consideration of the Rents, Covenants, Agreements, and Provisoes, hereinafter reserved and contained, and which by and on the part and behalf of the said Gavin Reid, his Executors, Administrators, and Assigns, are to be paid, kept, done, and performed, he the said SAMUEL CUNARD hath demised, leased, and to Farm letten, and by these Presents doth demise, lease, and to Farm let, unto the said Gavin Reid, his Executors, Administrators, and Assigns, All that tract, Piece, or Parcel of Land, situate, lying, and being on Lot or Township Number Sixty three - 63, in the Parish of Saint Andrew and in the County of Kings County, and bounded as follows, that is to say: - On the North by land leased this day to William Irving and land leased to the Presbyterian Church, on the West by land leased to John Power and on the South and East by Murray Harbour, Sable Point, and the Gulf of Saint Lawrence, the said piece of land now being in the occupation of the said Gavin Reid having been leased to John Dyamond (?) by John Duffus and others and S. Cunard on the 26th of July 1842, and this day surrendered by the said Gavin Reid, and is more particularly delineated and described on the plan of the said Township, containing about Forty six - 46 - Acres, be the same a little more or less, together with all and every the rights, privileges, easements, advantages, and appurtenances whatsoever to the said Premises belonging, or in any wise appertaining, or thereunto now or heretofore holden, used, occupied, or enjoyed. To Have and to Hold the said Piece, or Parcel of Land, and all and singular other the Premises hereinbefore demised, or expressed, or intended so to be, with their Appurtenances unto the said Gavin Reid, his Executors, Administrators, and Assigns, from the first day of May 1864 for and during and unto the full end and term of Nine hundred and ninety nine - 999 - Years, from thence next ensuing, and fully to be complete and ended; Subject nevertheless, to the Quit Rents, to become due, exceptions, reservations, covenants, easements and conditions in the Original Grant or Letters Patent of the said premises reserved and contained. Yielding and Paying therefor Yearly, and every Year during the said Term hereby granted, unto the said SAMUEL CUNARD, his Heirs and Assigns, the clear Yearly Rent or Sum of Two pounds eleven shillings and two pence currency without making any deduction or abatement whatever, for or in respect of any present or future Quit Rents, Land Taxes, or other Parliamentary, Colonial, or Parochial Taxes, Assessments, Payments, or Impositions whatsoever, by Yearly Payments on the first day of May in every year; the first payment thereof to become due and be made on the first day of May 1865 next ensuing the date of these presents. AND the said Gavin Reid doth for himself, his Heirs, Executors, and Administrators, covenant, promise, and agree with and to the said SAMUEL CUNARD, his Heirs and Assigns, in manner following, that is to say, that he the said Gavin Reid, his Executors, Administrators, and Assigns, shall and will, from time to time, and at all times during the continuance of the term hereby granted, well and truly pay, or cause to be paid, unto the said SAMUEL CUNARD, his Heirs and Assigns, the said Yearly Rent hereby reserved, upon the days and times, and in the manner hereinbefore mentioned for the payment of the same, according to the true intent and meaning of these presents. And Also, that he the said Gavin Reid, his Executors, Administrators, and Assigns, shall and will pay, satisfy and discharge, or cause to be paid. satisfied, and discharged, all and all manner of Quit Rents, Land Taxes, and other Parliamentary, Colonial, or Parochial Taxes, Rates, Assessments, Payments, or Impositions whatsoever, now or at any time hereafter during the said term hereby demised, payable, for or in respect of the said premises, or any part of them or the said Yearly Rent, or any part thereof, or which in case of any union of this Island with other Colonies may be imposed thereon for federal or confederate purposes. Provided always, nevertheless, and these premises are upon the express condition, that if the said Yearly Rent hereinbefore reserved, or any part thereof, shall be in arrear for the space of Twenty-one days next after the same ought to have been paid as aforesaid (being lawfully demanded), that then and in every such case, and at all times hereafter, it shall and may be lawful to and for the said SAMUEL CUNARD, his Heirs or Assigns, into the said premises hereinbefore demised, or into any part thereof, in the name of the whole, wholly to re-enter, and the same to have again, repossess and enjoy as in his or their former Estate, anything hereinbefore contained to the contrary thereof in anywise notwithstanding. And the said SAMUEL CUNARD doth hereby for himself, his Heirs, Executors, and Administrators, covenant, promise, and agree with and to the said Gavin Reid, his Executors, Administrators, and Assigns, in manner following, that is to say - That it shall and may be lawful to and for the said Gavin Reid, his Executors, Administrators, or Assigns, paying the Rents hereinbefore reserved, and performing the covenants and agreements hereinbefore mentioned or contained, and which on his and their part and behalf are or ought to be paid, done, and performed (subject, nevertheless, as aforesaid), peaceably and quietly to have, hold, occupy, possess, and enjoy the said hereby Leased Premises, with the appurtenances during the said term hereby granted, without the lawful let, suit, trouble, denial, eviction, ejection, interruption, or disturbance whatsoever, of, from, or by the said SAMUEL CUNARD, his Heirs, Executors, Administrators, or Assigns, or of, from, or by any other person or persons lawfully claiming or to claim by, from or under him, them, or any of them, or by or through his or their means, neglect, default, or procurement. And further, that until and up to the first day of May, One thousand eight hundred and seventy four, the said Gavin Reid, his Executors, Administrators, or Assigns shall have the right or option to purchase the freehold or reversionary interest of the said SAMUEL CUNARD, his Heirs or Assigns, in the said demised premises at and for the price or Sum of Thirty eight Pounds six shillings currency provided always, that all rent accrued due under the present demise together with the proportion of rent (if any) accruing between the last rent day and the time of exercising such right of purchase be first fully paid to the said SAMUEL CUNARD, his Heirs and Assigns, and that the Grantor or Grantors shall not be obliged to produce or make out any abstract of title or to covenant any further than against his or their own acts or the acts of those claiming under him or them.
      In Witness whereof, the said SAMUEL CUNARD, by GEORGE WASTIE DE BLOIS, his Attorney for that purpose lawfully constituted and appointed (by virtue of a Power of Attorney for that purpose duly executed and registered), and the said Gavin Reid have hereunto interchangeably set their Hands and Seals the day and year first above written.

      This Indenture made the Eighteenth day of December in the year of Our Lord One thousand eight hundred and eighty–eight, Between Alexander Reid, Senr of Murray Harbour, Lot or Township Number Sixty–three in Kings County in Prince Edward Island, Farmer, of the one part and Gavin Reid of place, County and Island aforesaid, Farmer, of the other part. Witnesseth that for and in consideration of the sum of Two thousand five hundred dollars of lawful money of the Dominion of Canada to the said Alexander Reid, Senr in hand well and truly paid by the said Gavin Reid at or immediately before the sealing and delivery of these presents (the receipt whereof I the said Alexander Reid doth hereby acknowledge and of and from the same and every part thereof doth acquit, release and discharge the said Gavin Reid, his heirs, executors, administrators and assigns forever by these presents). He the said Alexander Reid, Senr hath granted, released and confirmed and by these presents doth grant, release and confirm unto the said Gavin Reid, his heirs and assigns all that tract, piece or parcel of land situate, lying and being on Lot or Township Number Sixty–three (63), and bounded and described as follows: that is to say Commencing at a stake fixed on the shore of the Straits of Northumberland at the Northeast boundary of John McKay's land and running from thence North forty–five degrees West Seventy–one chains thence East twenty–one chains thence South forty–five degrees East until the line reaches the shore of the said Straits thence along the said Straits in a Southern course a sufficient distance to give sixteen chains and twenty links in a straight line or until it strikes the aforesaid stake or place of beginning making and containing about Ninety acres of land be the same a little more or less. Together with all and every the rights, privileges, easements, advantages and appurtenances whatsoever to the said hereditaments belonging or in anywise appertaining or thereunto now or herein before holden, used, occupied or enjoyed, To Have and To Hold the said messuages and tenements, land and hereditaments and all and singular or other the premises herein before granted, appointed and released or expressed and intended so to be with their appurtenances unto and to the use of the said Gavin Reid, his heirs and assigns forever. Subject Nevertheless to the Quit Rents to become due, exceptions, reservations, covenants and conditions in the Original Grants or Letters Patent of the said premises reserved and contained. And the said Alexander Reid doth hereby for himself, his heirs, executors and administrators covenant, promise and agree with and to the said Gavin Reid, his heirs and assigns in manner and form following, that is to say that it shall and may be lawful to and for the said Gavin Reid, his heirs and assigns from time to time and at all times hereafter peaceably and quietly to enter into and upon and to have, hold, occupy, possess and enjoy the said messuages, lands and other hereditaments herein before granted and released or expressed and intended so to be with their appurtenances and to receive and take the rents, issues and profits thereof and of every part thereof to and for his and their proper use and benefit without the lawful let, suit, trouble, denial, eviction, interruption, claim or demand whatsoever of or by me the said Alexander Reid my heirs or assigns or of or by any other person lawfully or equitably claiming or to claim by, from or under or in trust for him, them or any of them.
      In Witness whereof the said parties to these presents have hereunto their hands and seals subscribed and set the day and year first above written.
